These conditions of sale govern the sale of products marketed by Wineshop.it Srl (hereinafter for brevity referred to as Wineshop.it) through the website www.Wineshop.it, website owned by WINESHOP.IT S.r.l.. All contracts for the purchase of products through the above mentioned website and following the procedures set forth herein, including the seller and the Customer will be governed by these conditions of sale (in accordance with Italian law and in particular to the Legislative Decree no. 70 / 2003 in relation to electronic commerce, to the Legislative Decree no. 206/2005, with specific reference to the legislation on distance contracts and to the Legislative Decree 26/2023). Any changes or new conditions of sale will be promptly reported to the Customer, will be effective upon publication on the website and will apply only to sales made after publication.

Acceptance of sales terms

The contract between Wineshop.it and the Customer shall be concluded with the acceptance of the order by Wineshop.it. The acceptance is automatic, unless otherwise communicated to the client. By placing an order in the manner provided, the Customer declares to have read the information provided during the purchase procedure and accept the terms transcribed below. Therefore the Customer is warmly invited to read these conditions of sale and to print them or save them in another durable medium accessible to him.

How to buy

When placing the order Customer may only purchase products on the site http://www.Wineshop.it/en/ as described in the relevant information sheets. All the products on the site are sold by WINESHOP.IT S.r.l.. The information supplied products reproduce those supplied by the manufacturers. Wineshop.it, therefore, reserves the right to change the information of products to match those provided by the producers, without notice. The images on this site are provided to facilitate the Customer's recognition of the products, due to changes in the packaging by the manufacturer, the photos may not accurately reflect the appearance of the product delivered. The correct order is confirmed by Wineshop.it by a reply by e-mail, sent to the email address supplied by the Customer. This confirmation message will include the date and time of receipt of the order and an "Order Number" to be used in any further communication with Wineshop.it, as well as a reference to these conditions of sale. In the case of non-acceptance, Wineshop.it is committed to a timely notification to the Customer. All prices on this website are prices to the public and, therefore, inclusive of VAT. Wineshop.it reserves the right to change prices at any time, without notice. All published prices do not include possible taxes and/or duties applicable in the country of destination when this is different from Italy. These costs vary from country to country, they are charged to the customer, who has the responsibility to verify the amount with the competent customs authorities. Upon a written request we will refund customer of possible costs incurred.

Payment options

Customer can pay for the ordered products using different forms of payment, as depicted in the checkout phase of the purchasing process. Any additional costs relating to a particular mode of payment will be explicitly highlighted during the purchase process itself.

Delivery methods

Wineshop.it delivers its products via professional couriers. The shipping costs, in general, are charged to the Customer and are shown explicitly at the time of order. Depending on the area of destination of goods, deliveries may take place over a period of time ranging from 24 hours to four days, excluding circumstances (however, no later than thirty days from the date of order). The Customer on receipt of goods is required to verify its integrity, if the Customer has doubts about the integrity of the same, must indicate this on the delivery receipt. The Customer will have time 14 working days to verify the integrity of the goods and to communicate any damage by writing an email to Customer@wineshop.it. Within 14 working days Wineshop.it will refund the Customer.

Right of withdrawal

The Customer has the right to terminate the contract without any penalty and without specifying the reason, within 14 working days of delivery of products purchased, fairly and in good faith, by written notice to be sent to Wineshop.it by email to Customer@wineshop.it. In the communication the Customer must indicate the product or products for which it intends to exercise the right of withdrawal. The Customer can use for the communication the following WITHDRAWAL FORM. Return fees are charged to the customer. Wineshop.it will refund to the Customer all payments received for the product or products for which it has exercised the right of withdrawal (including original delivery costs) within 14 days of Customer's communication.

Warranties

Wineshop.it guarantees that the delivered products are equal to those shown and described on the site. For all products sold that is the responsibility of the manufacturer. The manufacturer is also responsible for the truthfulness and completeness of the information on the packaging.

Privacy

The personal information requested to complete the order are collected and processed by Wineshop.it on digital media, in order to meet the obligations under the contract with the Customer, and will not, under any circumstances, licensed to third parties. Wineshop.it guarantees its Customers the respect of rules on the processing of personal data covered by the privacy code under LD. No. 196 of 30.06.03. The responsible of data management and handling is Wineshop.it Srl, Via Michelangelo da Caravaggio, 19-24010 Ponteranica (Bergamo), in the person who from time to time is the legal representative, unless a manager is appointed pursuant to art. 29 of Legislative Decree no. n. 196/2003. The Customer, at any time, have the right to withdraw consent to the processing of personal data by written communication sent to Wineshop.it, at the above address. The Customer, in accordance with art. 7 of the Decree. N. 196/2003, has the right to access their data in the manner specified therein. Marketing communications will be sent only with the explicit consent of the Customer released together with the processing and sending the registration form online.

Reviews

The general reviews on our service that appear in the "What others say" section at the footer of our site are randomly extracted from the "Our Customer's Comments" page. The reviews listed on the "Our Customer's Comments" page are reviews made exclusively by our customers listed in chronological order. We adopt procedures that guarantee that these reviews have actually been issued by one of our customers who has made a purchase on our site. Reviews are in no way solicited with the promise of a benefit, nor manipulated. Of course we also publish the negative reviews. Unlike the above, unfortunately we cannot guarantee the authenticity of all the specific reviews we receive for products for sale on our site and published in the "Reviews" tab for each product.

Personalization of prices and search results

We do not use any automated processes to display a personalized price to our customers. The customer has full control over the search results, which are displayed as desired.

Protection of minors

Wineshop.it does not sell wine or other alcoholic products to persons under 18 years. The courier will not deliver the wine or other alcoholic products to persons under 18 years, and will require a photo ID to verify the age.

Claims

Any complaint must be addressed in writing to Wineshop.it Srl - Via Michelangelo da Caravaggio, 19-24010 Ponteranica (Bergamo) or by email at info@wineshop.it.

Applicable jurisdiction

The sales contract between the Customer and Wineshop.it is concluded in Italy and governed by Italian law. For the solution of civil and criminal litigation arising from the conclusion of this contract of distance selling, if the Customer is an italian consumer, the court having jurisdiction is the one of the town of residence; in all other cases, the court of Bergamo (Italy) have jurisdiction.
